1. Definitions

In the context of these terms and conditions, the following words shall have the following meanings:

  • "Maggie’s" means The Maggie Keswick Jencks Cancer Caring Centres Trust a registered charity in Scotland (SC024414) and registered as a company limited by guarantee in Scotland (SC162451). Registered address:  Maggie’s, The Gatehouse, 10 Dumbarton Road, Glasgow G11 6PA.
  • "Website" means any website under the ownership or control of Maggie’s from which a link has been created to these terms and conditions;
  • "Material" means all of the information, data, text, graphics, links or computer code published on, contained or available on the Website;
  • "User" and/or “you” means the individual, firm, company or organisation accessing the Website and/or ordering any goods or services, registering for any events and/or making any donations or contributions.

2. Applicable terms and conditions

The Website is owned by Maggie’s and any use made of the Website (including registrations and donations and orders for goods or services made via the Website), is subject to these terms and conditions and Maggie’s Privacy Notice which is available at www.maggies.org/privacy

By using the Website, you: (i) confirm that you accept these terms and conditions and that you agree to comply with them; and (ii) acknowledge that you have reviewed and are familiar with Maggie’s Privacy Policy.

If you do not agree to these terms, you must not use the Website.

Maggie’s may, at its sole discretion, modify or revise these terms and conditions at any time by updating the text of this page.


3. Use of the Website

Anyone is entitled to view any non-password protected parts of the Website and to use for their own purposes the information contained therein, provided:

3.1 it is used for information purposes only, for reproduction for personal use only and not for reproduction on any other website or for commercial gain;

3.2 any links created to the Website are notified to and approved by Maggie’s before they are created; and

3.3 no part of the Website is copied, stored in a retrieval system, or transmitted in any form or by any means to any third party without the written permission of Maggie’s.

4.2 The names and logos of Maggie’s and all related product and service names, designs, marks and slogans are the trade names, service marks or trade marks of Maggie’s and may not be used without the prior consent of Maggie’s.

4.3 All works in the nature of databases attract database rights.

4.4 Your contributions

Maggie’s may retain your contribution and may choose to display your postings elsewhere on any website. Maggie’s may also publish your contribution in other media. By submitting your contribution you irrevocably consent to such use of your contribution. Maggie’s reserves the right to remove or redirect contributions it considers to be objectionable, offensive or violate copyright. Maggie’s reserves the right to edit and alter submissions at all times.

Maggie’s rights in relation to your contribution

Publication of your contribution will be at Maggie’s sole discretion; we will try to credit authors where possible but may not always do so;

All posts are subject to moderation by Maggie’s. Maggie’s reserves the right to edit, adapt, move or delete any contribution. Maggie’s will take reasonable steps to inform the User how or why their post is or was inappropriate, but may not always do so in every circumstance.

Maggie’s takes your privacy very seriously; we will only use your personal information in accordance with the terms of our Privacy Notice

By submitting a contribution to Maggie’s you acknowledge and agree that you have read and accept the terms of our Privacy Notice and these Terms and Conditions.

The Website is intended to provide general information only and, as such, should not be considered as a substitute for advice covering any specific situation.

The User shall indemnify and hold harmless Maggie’s, its employees and agents, against all claims, liability, losses, damages and expenses including, without limitation, legal fees and costs arising out of or incurred as a result of any claims made, or litigation brought, against Maggie’s, its employees and agents, as a result of the use by the User of the Website, the Material or any part thereof for whatever purpose, to the fullest extent permitted by law.

Maggie’s does not represent or warrant that the information accessible via the Website is accurate, complete or correct. 

Maggie’s has no liability whatsoever in respect of any use which you make of such information except in the case of personal injury or death caused by the negligence of Maggie’s.

Maggie’s hereby disclaims all warranties and conditions with regard to the Material and any goods or services supplied in relation to the Website, whether express or implied or statutory (including all implied warranties and conditions of merchantability and fitness for a particular purpose) to the maximum extent permitted by law.

In no event shall Maggie’s be liable for any indirect, punitive, special, incidental, or consequential damages whatsoever even if Maggie’s has been advised of the possibility of damages including, without limitation, damages for loss of use, data or profits arising out of or in any way connected with the use or performance of the Website, interruptions or delays to the Website, the provision of or failure to provide services, or for any information, Material, services obtained through the Website or otherwise arising out of the use of the Website, whether based on contract, tort or otherwise to the fullest extent permitted by law.

12. Viruses

We ensure that there are appropriate technical controls in place designed to protect your personal information.

For example, our data and hardware are housed in a secure data centre, which is accessed via encrypted network connections for protection. 

We undertake regular reviews of who has access to information that we hold to ensure that your information is only accessible by appropriately trained staff, volunteers and contractors.

Sometimes we use the services of our corporate partners or other reputable companies to collect or process personal information on our behalf.

Before we permit a company to collect or process personal information on our behalf we seek to put a written agreement in place with appropriate controls to secure your personal information.  

Although we use appropriate security measures once we have received your personal information, the transmission of data over the internet (including by email) is never completely secure. 

We endeavour to protect personal information but we cannot guarantee the security of data transmitted to us or by us.


13. Online transactions

Maggie’s reserves the right to vary event registration fees and the prices of any goods or services listed without notice.

All event registrations and orders for goods or services are subject to availability and Maggie’s reserves the right to refuse to accept any registration and to refuse to supply any goods or services to any individual.


14. Security

Although the Website uses payment gateways such as Paypal in areas where online payment details are accepted, the security of information and payments transmitted via the Internet cannot be guaranteed.

Any loss incurred or sustained by any User who transmits information by means of email or other Internet links shall be borne solely and exclusively by such User and in no event shall any such loss in whole or part be borne by Maggie’s or its agents.


15. Force majeure

Maggie’s shall not be held to be in breach of its obligations hereunder nor liable to the User for any loss or damage which may be suffered by the User or any other person due to any cause beyond its reasonable control including without limitation any act of God, fire, storm, flood, lightening, disease, strike, trade dispute, act of terrorism, any act or omission of government or regulatory bodies or communications operators.



16. General

16.1 If any provisions of these terms and conditions are held to be invalid or unenforceable, the validity or enforceability of the remaining provisions shall not be affected.

16.2 These terms and conditions (as amended from time to time) constitute the entire agreement between Maggie’s and the User and supersede all other (prior or contemporaneous) communications and proposals, whether electronic or written, between the User and Maggie’s. 

Maggie’s reserves the right to update these terms and conditions from time to time and any updated version will be effective as soon as published on the Website.

16.3 Any failure of Maggie’s to exercise or enforce any of its rights under these terms and conditions shall not be deemed to be a waiver of any such rights or operate so as to bar the subsequent exercise or enforcement or any such rights.


17. Jurisdiction

If you are a consumer, the terms and conditions and the use by the User of the Website shall be governed by the laws of England and Wales and the parties hereto submit to the exclusive jurisdiction of the courts of England and Wales in all disputes arising out of or relating to the Website and/or any transactions made on the Website, or these terms and conditions except that if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are resident of Scotland, you may also bring proceedings in Scotland.

If you are a business, the terms and conditions and the use by the User of the Website shall be governed by the laws of England and Wales and the parties hereto submit to the exclusive jurisdiction of the courts of England and Wales in all disputes arising out of or relating to the Website and/or any transactions made on the Website, or these terms and conditions.
